Voters in at least 40 jurisdictions will decide in this election whether they want medical-marijuana dispensaries in their communities.

The wave of ballot measures will provide the best insight since the state's medical-marijuana boom began into how a broad spectrum of Colorado voters feels about the current system. But medical-marijuana advocates insist that any decisions to ban dispensaries should not be viewed as a broader indictment of medical marijuana.

"If a large number of these measures pass, it's not because people want to deny medicine to their neighbors," said Betty Aldworth, executive director of the pro-dispensary group Coloradans for Medical Marijuana Regulation. "It's that we haven't effectively educated voters on the needs of their neighbors."

The elections are an outgrowth of a bill the legislature passed earlier this year that gives cities and counties explicit authority to either ban or regulate dispensaries. Since Gov. Bill Ritter signed that bill into law, officials in 25 cities have decided to ban dispensaries, while officials in 19 other cities have enacted dispensary regulations, according to a list compiled by the Colorado Municipal League.

Voters in 26 cities from tiny Hillrose in eastern Colorado to Aurora, the largest Colorado city currently without a dispensary - will have a choice on the ballot whether to allow dispensaries. Voters in 14 counties will also decide on allowing dispensaries in the unincorporated parts of the county.

A coalition of medical-marijuana- connected businesses has filed a lawsuit in El Paso County seeking to get that county's ballot initiative tossed out. Because the county first decided to regulate dispensaries - after which several opened - and now might ban them, attorney Jessica Corry said the measure amounts to a "regulatory taking" that would force existing, lawful businesses to close shop.

"We're fighting for not just the constitutional rights of patients but for that long-cherished Colorado ethos of live and let live," Corry said.

Other unresolved lawsuits argue that local bans are illegal, advocates say, because dispensaries are protected by the Colorado Constitution.

El Paso County's measure has drawn perhaps the most interest. A group called Citizens for Safer Communities has taken in about $3,800 in contributions - many from dispensaries - to fight a ban. Meanwhile, a group organized by Fountain resident Kenneth Lippincott to support bans in El Paso County and Fountain has collected about $2,400. That group's largest donor is St. Dominic Catholic Church in Security.

Ban opponents say that eliminating dispensaries forces medical-marijuana patients into the black market and marijuana sales into residential neighborhoods. Lippincott, who coordinates a neighborhood watch program in his community, said he supports a ban because he worries commercial sales of marijuana could lead to bigger social problems and crime.

"I'm afraid what's coming on the tail end of the pot shops is hard-core meth and other drugs," Lippincott said.

Indeed, the elections may offer an early hint at how inclined Colorado voters would be to expand marijuana access through a possible 2012 legalization ballot initiative. But Mason Tvert, head of the pro-legalization group SAFER, said he doesn't think that's the case.

"I'm not really looking at them as an indicator to move forward," Tvert said. "These votes are specific to medical marijuana . . . which is not the same as broader marijuana regulation."

Colorado Springs: MMJ Sales Tax Hits New "High"
The August sales of medical marijuana and marijuana-infused products generated $56,991 in sales tax revenue for the city, a record high and a nearly 12 percent increase from July.

So far this year, the city has collected nearly $325,000 in sales tax revenue from the medical marijuana industry - almost three times the amount collected all of last year.

El Paso County: 15 Companies Suing El Paso County's Commissioners

El Paso County Still Considering MMJ Ban - August, 19th, 2010

EL PASO COUNTY, Colo. -- After more than six hours of public comments on the pros and cons of medical marijuana in El Paso County, commissioners need more time.

Elected leaders are considering putting a ban question on the November ballot.

They've delay that decision until August 26. During that time they'll be discussing how to handle dozens of businesses who have already set up shop. There's debate over whether or not to allow them to operate, even if voters decide to ban medical marijuana dispensaries.0

Many who showed up for the marathon meeting are opposed to putting the question to voters because they believe it puts businesses and livelihoods at risk. "Not less than one month ago took the county took fees, the state is taking fees from business owners and now they want to come in and shut it down after taking thousands of dollars from businesses that are paying taxes," said Kyle Wendlend, owner of Today's Healthcare.

An owner of a construction company said the only growth and new business he seen in the local economy has been in the medical marijuana industry. County Commissioner Amy Lathen said many citizens who have contacted her don't want the businesses in the county. She also doesn't want the county to become a grow operation hub for other regions. Other speakers said the grow and distribution centers put public safety at risk.

County commissioners will consider three medical marijuana items at their weekly board meeting Thursday, including whether to ask voters in November if marijuana-related businesses should be banned in unincorporated El Paso County.

Commissioner Amy Lathen, who represents eastern El Paso County, said: "The right place for resolution of the issue is on the ballot. I trust the people."

Commissioner Wayne Williams,who represents the northern part of the county, agreed. "Given the way the state Legislature structured the law, the appropriate thing to do is let voters make the decision."

Dennis Hisey, chairman, said he had "mixed feelings"” and wants to hear from both sides. Hisey said he's concerned that a ban would drive the marijuana businesses underground.

If a measure does go to voters and is approved, medical marijuana centers, grow operations and manufacturers in the unincorporated part of the county would have to close their doors by Nov. 30.

The proposed ban would not impact the constitutionally protected use of medical marijuana by patients or their primary caregivers.

All three commissioners said they’ve received pro and con emails from residents. "People feel strongly on both sides of the issue," said Williams. "Letting folks decide for themselves seems to be the right thing to do."

Regardless of the outcome of that issue, commissioners are likely to hammer out land-use regulations and licensing requirements to bring more oversight of medical marijuana facilities.

"We won't know until November what the people decide. And if we don't put it on the ballot, we need regulations as soon as possible," Hisey said.

The land-use regulations and licensing procedure would be similar to the rules governing liquor license applicants. "We chose the liquor license model because we're familiar with it and it's working well for us." said Hisey.

Medical marijuana has been legal in Colorado since 2000 when voters approved Amendment 20. But marijuana businesses exploded in 2009 when the White House said it wouldn't enforce federal marijuana laws in states where the substance is legal for medical uses.

In Colorado Springs, the number of dispensaries grew from a handful in 2009 to more than 200. Related businesses, including grow operations and manufacturers that make food products, drinks and ointments, also appeared.

Under a proposed "Medical Marijuana Policy" to be considered by the commissioners, medical marijuana operators would have to apply for a two-year license. The El Paso County Sheriff's Office would conduct background investigations and the county’s Development Services would ensure the proposed operation complies with land-use regulations.

The county adopted temporary land-use rules in December 2009 that relegated medical marijuana businesses to four commercial or industrial zones.

The businesses cannot be located within 500 feet of a school, park, religious institution, licensed drug and alcohol treatment facility or childcare facility.

Once the applicants clear the background investigation, they'll have to survey neighbors and go before the board for a hearing.

Once approved, the businesses will not be allowed to prominently display medical marijuana products. Owners would also be required to have 24-hour video surveillance cameras that monitor entrances, exits, transaction counters and vaults.

Watch out as you drive down West Colorado Avenue these days. You might get a contact high.

From Interstate 25 to Old Colorado City, you'll pass a medical marijuana dispensary on almost every block. Businesses like Springs Natural Medicine, The Healthy Connection and Altitude Organic Medicine - "home of the $39 special" - can make you feel like you're in pot head heaven.

But for residents and business owners in the midst of the business boom, their presence has raised eyebrows and often ire.

"It's no longer West Colorado Avenue, it's West Cannabis Avenue," said Jim Lamphear, who lives a block north on Pikes Peak Avenue. Lamphear chuckled to himself when he saw the first dispensary pop up because he figured every neighborhood would have one. But he's not chuckling any more.

"They just came suddenly: boom, boom, boom. Soon enough, every time a storefront opened up you knew what was going in there."

Lamphear and his wife, Ella, bought their historic home 38 years ago - back when they say the neighborhood was rundown and their friends and family questioned the move. Now after years of renovating their house and making an immaculate backyard garden, they"ve been delighted to watch other neighbors follow suit and upgrade the neighborhood one home at a time.

He worries the dispensaries could turn off potential buyers and erode the home values he and his neighbors have worked to raise.

"Like any business that operates on the fringe of morality, like adult bookstores and topless bars, dispensaries threaten the neighborhood concept," he said.

Lamphear's neighborhood isn't the only one that has been inundated with dispensaries. As of July 29, the City of Colorado Springs had active sales tax licenses for 230 dispensaries. While there are dispensaries in virtually every neighborhood, West Colorado Avenue, East Platte Avenue and the area circling the University of Colorado at Colorado Springs are among a handful that have several dispensaries apiece.

Tanya Garduno, director of the Colorado Springs Medical Cannabis Council, said dispensary owners are trying their best to be good neighbors. Many post signs warning customers to be quiet and respectful outside of the business and not to litter. When the council receives complaints, Garduno said members follow up to make sure everything is going as it should. She said the council would love to meet with neighborhood groups to discuss their concerns face-to-face.

"We will make every effort possible to do what we can," she said. "We're not trying to be fly-by-night. We're not trying to get rich quick. In order to be here for the long run, we have to be good neighbors."

Still, she said, she knows that there will always be unhappy people.

"Sometimes, no matter what the dispensaries do, the neighbors won't be happy," she said. "A lot of times, it’s that they don't like the business itself."

Lamphear admits that might be part of the problem. He hasn't noticed an increase in crime and admits that it's a bit reassuring to know where marijuana is being sold in his neighborhood. Still, he wishes the dispensaries weren’t allowed in residential neighborhoods.

Soon enough, he fears, the friendly, small-business feel of West Colorado Avenue will change beyond recognition.

Not everyone in the neighborhood shares those fears. Firehouse Southern Style BBQ on West Colorado Avenue is across the street from a dispensary, and Firehouse general manager Peter Karnincic said he has no problems with his new neighbor. He hasn't noticed an increase in crime or decrease in business since it moved in.

To be friendly, and drum up business, he even stopped by to say hello.

"I gave some of those guys our menu so if they get the munchies they can come over and eat," Karnincic said. He said a few have taken up his offer.

Six blocks west of Firehouse, Jug & Basin Antiques owner Joe Roina isn't so enthusiastic. His customers are mainly tourists and antiques collectors, two groups that he believes might be turned off by dispensaries. Also, he objects to them as a resident - he and his family have lived at the store more than 30 years.

"We're scared that it's going to bring a clientele that is not conducive to family life," he said. "I'm not happy. We raised our kids in this house and I feel for the other kids out there."

On Pikes Peak Avenue, homeowner Becki Davis doesn't see what all of the fuss is about. She has no problem with medical marijuana, in fact, she thinks marijuana should be legalized. Yes, there are a lot of dispensaries in the area, she said, but they aren't hurting anyone.

"We have liquor stores in our neighborhood and nobody seems worried about those," she said.

In time, she suspects the dispensary inundation on West Colorado will cure itself. Soon enough, most of the dispensaries will disappear as customers flock to bigger and better places.

"Natural selection," she said. "Hey, that would be a good name for a pot shop. Maybe I should open one."

Federal Government Is Impelled to Support Medical Marijuana by the American Medical Association

The American Medical Association, which is the largest doctors' organization in the USA, has reconsidered its position towards medical marijuana and currently supports exploration and medical research on marijuana for medicinal use. On Tuesday, the group has persuaded the federal government to re-evaluate its controlled substance categorization of marijuana in Schedule I, which unfairly maligns the plant alongside with some of the most hazardous narcotic substances, such as LSD and heroin.

AMA officer of board, Dr. Edward Langston specifies that just a least number of controlled, casual tests have ever been maintained on ingested marijuana in spite of medical research in by medical marijuana doctors and other experts, which encompasses more than thirty years. As for now, the group encourages new researches on medical marijuana's effectiveness in spite of its support for the classification of marijuana in Schedule I, since 1997, because more and more medical marijuana doctors appear over time.

This year, Obama's administration has also ordered federal narcotics agents to stop prosecuting people who use and distribute medical marijuana (including medical marijuana doctors) in the states that have legalized it, which indicated an alteration of the course from past administrations' stringent opposition to the use of medical marijuana, even for people that have medical marijuana cards in the states that have legalized the plant for medical use. At the moment, fourteen states lawfully permit the use of medical marijuana and around twelve other states have started to think about doing so. The American Medical Association is interested in study, which takes in account alternative methods of using medical marijuana, apart from therapeutically smoking it. Lawyers for medical marijuana speak about other helpful modes of medical marijuana use, involving the THC-rich cannabis oil extraction, which is claimed to be able to heal cancer patients. Today, no one is persecuted for the use of cannabis if a legal Medical Marijuana Card is present.

The reaction of the federal government to the AMA's stance has been pretty silent in spite of loosened federal prosecution of medical marijuana use and medical marijuana clinic workers. DEA - the Drug Enforcement Administration - repeated the status of marijuana as a Schedule I substance and the FDA - Food and Drug Administration - refused to give any commentaries on the situation. The American Medical Association was one of the sole groups to object the first federal limitation on cannabis, which were established back in 1937. It still persists to decline casual idea that medical marijuana is a myth, in spite of its past support of Schedule I narcotic classification. The organization even objected an offered amendment, which would have settled its managerial policies in resistance to ingested marijuana as a safe way of use for medical marijuana treatment. In fact almost any medical marijuana clinic provides edible products of medical marijuana for patients with medical marijuana cards.

Marijuana support groups are joyous about the new stance of the AMA and the extending change of attitude towards medical marijuana and everything related to it - medical marijuana doctors, medical marijuana clinics, etc. While federal administration still resists against the medical marijuana legalization, referring to the FDA consideration in objection to its secure use as medicine, popular belief persists to change in favor of further study and medical use of marijuana. Last year, the second largest doctor group, the American College of Physicians has uttered similar support for improved research and reassessment of medical marijuana. Also, the California Medical Association passed its own opinions that referred to marijuana criminalization as a "failed public health policy."

The moods are changing towards frank research of the medical marijuana benefits. The attraction for further proof-based study by acknowledged medicinal organizations is a step in the proper direction on the way to legalizing medical marijuana for legal and safe medicinal purposes

Colorado's Medical Marijuana Business - August 1st, 2010

House Bill 1284 - Revised Edition - May Shut Down over 75% of Colorado Dispensaries

This is it. The moment of truth for MMJ in Colorado.

Read this summary, it may save your dispensary - or at least keep you out of jail.

July 1, 2010: You must be operating an established medical marijuana center or have applied for a local license.

August 1, 2010: State registration fee due (amount unknown at this point). $5,000 to $35,000

Sept. 1, 2010: A medical marijuana center must be producing 70% of its medicine either onsite or with separate licenses for "optional premises cultivation." An inspector with a gun and a badge will be at your location to count your plants and your patients.

July 1, 2011: State licensing fee due (cost unknown at this point). $7,000 to $35,000

    • Persons PROHIBITED as licensees
      • Until annual fee has been paid
      • No Criminal history
      • Of any officers, members, stockholders, etc.
      • A physician making MMJ recommendations
      • A person under 21
      • A person who has failed to:
      • Provide surety bond and file any tax return with taxing agency
      • Pay any taxes, interest, or penalties due
      • Pay any judgments
      • Default on a student loan
      • Pay any child support
      • A person who has discharged a sentence within 5 years
      • A person who employs another person at a MMJC who has NOT passed criminal history check
      • A law enforcement officer
      • A person for a location that is currently licensed at a retail food or wholesale food registrant
      • A person who has NOT been a Colorado resident for at least 2 years
      • Prior to December, 15th, 2009
      • SLA has access to CBI and FBI reports

      House and Senate Pass Draconian Bill - HB 1284 - May, 6th, 2010

      Today after months of debate (and years of doing nothing) a majority of our elected officials voted to pass HB 1284.

      The bill will now be sent back to the House. The House will either approve the Senate's amendments or send the bill to conference committee to hash out a deal. If both houses agree, the bill will be sent to the Governor's desk.

      As written, the Bill is a clear violation of patient's rights; however, that has not seemed to stop Chris Romer.

      This is bad news for all our the hard working caregivers, dispensary owners, and independent growers across our great State. Go Green Cross will be fine; however, we are worried about our fellow dispensaries and growers.

      Here's the skinny of HB 1284 as it stands today

      • Effective Immediately - Cities and Counties can ban dispensaries (clear violation of the Constitution)
      • Effective 1 August, 2010 - 1 year moratorium on new dispensaries Statewide
      • Effective 1 August, 2010 - all dispensaries must register with the State and pay between $7,000 - $35,000
        • get this, payment of the fee is non-refundable and does not guarantee approval
        • there are 3 classes of licensing (each with a separate fee)
          • Center
          • Cultivation
          • Infused Products Manufacturer
        • failure to pay the fee and fill out the State form will result in evidence of bad character and automatically disqualify you from ever getting a license
      • Effective 1 September, 2010 - all dispensaries must grow 70% of medicine in house
        • this must be certified by by the State - and paid for by you
      • Effective 1 July, 2011 - all dispensaries must be in complete compliance at both State and Local levels

      This is just a brief 'taste' of the bitterness HB 1284.

      Colorado Lawmakers Reject Ban on Dispensaries - May, 4th, 2010

      • Yesterday, Colorado Lawmakers rejected a proposal by Republican Senator Scott Renfroe that would have asked voters to ban dispensaries and allow only individuals to provide MMJ to patients.
      • Scott Renfroe tried very hard to convince other members of the House and Senate that dispensaries were not authorized under Amendment 20.

      However, Amendment 20 clearly states in paragraph 2 (d):

      • (d) Notwithstanding the foregoing provisions, no person, including a patient or primary care-giver, shall be entitled to the protection of this section for his or her acquisition, possession, manufacture, production, use, sale, distribution, dispensing, or transportation of marijuana for any use other than medical use.

Colorado House Passes HB 10 1284 - April 20th, 2010

420 may go down as a day of defeat for the safe, affordable and legal access to Medical Marijuana for Citizens of Colorado.

House Majority Leader Paul Weissmann, D-Louisville, stated that legislators were succumbing to “reefer madness."

Ironically, as thousands of citizens gathered outside the Capital on 420 to express their right to use MMJ, inside the Colorado House legislatures TIGHTENED the rules on Medical Marijuana in Colorado. The Bill passed on a voice vote and now goes for a final recorded vote. It could pass final vote any day.

  • HB 10 1284 -
    • Creates a multitude of licenses for dispensaries, growers and infused product manufacturers
            • this will only increase the cost for patients - the fees? somewhere between $5,000 - $50,000
              • bon voyage small business man or woman
    • Creates a requirement that 'centers' must grow up to 70% of product in stock on any day
      • what other business in America is required to produce 70% of what they offer on any given day?
      • does Wal-Mart or even a liquor store have to produce 70% of their products on any given day?
      • as a business professional, this is simply absurd and designed to wipe out the local grass roots businesses
      • could this be a way to allow large out of State corporations to take over our local markets?
        • Hello California.
      • this will LIMIT the ability of caregivers and centers to provide the best products at all time for all reasons
      • this will also increase the cost for patients
    • Creates new fees at State, County, City and Municipality levels
      • guess what? this will increase the cost for patients
    • Creates a new task force that would be able to enter and control almost EVERY aspect of a center, grower or Chef
      • ability to enter premises at all time for any reason
      • control and monitor facilities without a warrant
      • search and monitor facility operation, counting every gram, plant and person without a warrant
      • this is a ABSOLUTE intrusion on our rights as citizens of the United States
        • warrant-less searches? hm? that should go over well...
        • does the State want me to spend my time filling out forms, paying obscene licensing fees at all levels, and speaking with inspectors? when should I have time to actually CARE for my patients?
          • we need to spend our time securing the best products for our patients
            • remember the Colorado Constitution anyone?

It is a 'wake up call' of how much can go wrong when we spend our time 'lighting up' outside the HOUSE instead of 'speaking up' in to our elected officials.

With all due respect to those who 'light up' in public, we respectfully suggest that in accordance with Amendment 20, Article XVIII, Section 14 that we NOT flaunt our rights but abide by them with respect to our neighbors that may not smoke.

The Colorado Constitution does not allow anyone to smoke in public places.

(II) Engage in the medical use of marijuana in plain view of, or in a place open to, the general public.

Colorado's Top DEA Agent Comments on Medical Marijuana Dispensaries - April 7th, 2010

The Bad: About a week ago the DEA seized Chris Bartkowicz's grow in Highlands Ranch, Colorado. Chris is expected to plead guilty in federal court.

The Bill has the potential to drastically change the current model.

HB 10-1284 is more about building barriers and establishing fees and less about a patient's rights to safe, affordable and logical access to medical marijuana in Colorado. 70/30 rules? Are you kidding'? Does McDonald's have to produce 70% of the drinks they sell at all times? Establishing a $5k bonding fees, dual licensing fees, CBI finger-print background checks (and fees) for all employees, creating new forms, and even special ID cards (that I'm sure will cost even more money.)
